EACoE Environmental Advisory Committee of Erin

EACoE LogoGoal: To advise and assist the Council and the citizens of the Town of Erin in the protection, enhancement, restoration, management and appreciation of our common natural heritage and in ensuring that our communities are planned for environmental sustainability, health and respect for all life.

Guiding Principles: These principles are intended to guide and assess the actions of the Environmental Advisory Committee of Erin. In carrying out its mandate, the EACOE will be governed by these principles and will not undertake any actions that compromise its commitment to these principles.

  • Sustainability
    The sustainable integrity of ecological systems will be a primary consideration in all activities and decision-making processes.
  • Carrying Capacity
    The natural limits of ecosystems must be respected and the cumulative environmental effects of development assessed.

TEHC Town of Erin Heritage Committee

TEHC LogoTerms of Reference and Role of The Town of Erin Heritage Committee as defined by Council:

  • To initiate and provide Council with advice with respect to the  properties and districts under Parts IV and V of the Ontario Heritage Act. designation
  • To provide advice as to how the conservation of heritage features may be achieved through the adoption of appropriate municipal policies such as zoning by-laws and Official Plan policies under the Planning Act.
  • To establish criteria for the evaluation of properties of heritage value or interest.
  • To establish and maintain an inventory of properties of heritage value or interest, which inventory shall be forwarded to Council for information.
  • To promote the awareness of the Town of Erin's heritage through publications, events, public speaking, displays, signage and plaques.
  • To be circulated on all relevant development, demolition and capital project applications for the purposes of providing comments on any relevant matters.
  • To liaise between the Town and the Wellington County Museum and Archives and other heritage organizations, as desirable, to implement the objectives of the Town of Erin.
  • To provide advice to property owners with respect to the restoration of heritage buildings, or the making of sympathetic improvements thereto.
  • To report to Council on Heritage in a broader sense as it relates to man-made features (e.g. altered landscapes, architecture, archaeological remains), the natural environment (e.g. cultural landscapes, forests, wildlife, geology, rivers) and culture (e.g. oral history, skills, story, dance, music).
  • To advise Council as a means of conserving heritage properties through a variety of means, review available funding sources and advise on current heritage legislation.

Fencing and Fence Disputes and Animals/Fowl Running at Large or Trespassing:
 
The Line Fences Act establishes the rule that if a property owner wants to construct a fence to mark the boundary between his/her property and the neighbouring property, that property owner is permitted to construct a fence on the boundary line. The Line Fences Act does not apply to boundary line disputes. The Line Fences Act provides for an arbitrating procedure to resolve a disagreement between neighbouring property owners when one owner wants to construct, repair or maintain a fence on the boundary line but the other owner is not in agreement on cost-sharing, fence-type being constructed or both. Upon application and payment of fees, appointed fence-viewers are assigned to resolve disagreements.

Duties and Powers of Fence-viewers
 
Fence-viewers appointed by council are responsible to examine the premises upon application and payment of fees by either adjoining landowner and shall hear evidence and may examine the owners and their witnesses on oath.
 
The fence-viewers shall make an award respecting the dispute.
 
The fence-viewers shall
  • describe the location of the fence;
  • who shall construct the fence 
  • the type of construction including the materials to be used;
  • the date of completion;
  • who shall be responsible for maintaining the fence;
  • and shall state the percentage each owner is responsible for

 
 
Duty of a Poundkeeper:
 
Each Poundkeeper shall provide premises for the enclosure and safe keeping of any animal or animals impounded, and shall ensure that the premises are clean and in good repair.    The Poundkeeper may establish from time to time temporary premises for the confinement of livestock apprehended within or outside the municipal boundary.
 
Each Poundkeeper shall detain impounded animals until the owner has paid the costs and charges of such impounding, care and keeping and appraised damages and if not paid shall be authorized to sell the animal(s) as set out in the appointment by-law and applicable legislation.

 
LIVESTOCK EVALUATOR: (Re: Livestock kills)
 
The Town of Erin provides a service to provide relief to farmers who lose livestock due to animal attacks.
 
Procedure
Under the Ontario Livestock, Poultry and Honey Bee Protection Act (LPHBPA), livestock and poultry producers are entitled to make claims to their local municipality for livestock losses attributable to attacks by wolves, coyotes or dogs.  Maximum amounts of compensation are regulated and a  fact sheet regarding this program can be found on the website for the Ministry of Agriculture, Food and Rural Affairs (OMAFRA).

If a farmer discovers that one of their farm animals has died, do not touch the animal or disturb the surrounding area.  Immediately, the farmer should contact one of our local livestock valuators:

  • Fred Cox - (519) 855-4670 or
  • Neil Baldwin at (519) 855-4518.  

The livestock valuator will determine the type of kill involved and obtain any other necessary information as required.

When the on-site evaluation is completed, the livestock owner must then attend at the Town Office, which is located at 5684 Trafalgar Rd. (south of Hillsburgh), with the required documentation for processing.
 
The Town of Erin will then assess each claim on a case-by-case basis and begin the process for reimbursement if applicable.

The Town Appointed Livestock Valuers duties include:
 
Valuers are responsible for conducting an investigation, assessing the extent and amount of damage and determine an award regarding livestock claims. The compensation is limited to a maximum dollar value for each class of livestock as stated by regulation. 
 
The calculation of the award is generally based on an estimate of the weight of the animal and the current market price. 
 
Valuers muct determine the type of predator responsible for the losses. If a predator was responsible then he/she must determine whether the predator was a dog, coyote or wolf and determine the extent and amount of the award.
 
The Valuer must state clearly all the specific evidence that led him/her to conclude that wolves were responsible for the loss/damage. The valuer is expected to list all of the particulars that lead to the conclusions of the cause of death, the predator which caused the damage, and the assessment of reasonable care having been taken.
 
The valuer is expected to estimate the live weight of the animal killed or injured and compensation based on market value of the animal involved.
 

 
 
Property Standard Committee  - Duties and Responsibilities

The Property Standards Committee may confirm the Property Standards Order or modify or quash the order or extend the time for complying with the order provided that in the opinion of the Committee, the general intent and purpose of the Property Standards By-Law and of the Official Plan of the Town are maintained.

The Committee must hold a hearing if an owner or occupant upon whom an Order has been served is not satisfied with the terms and conditions of the Order.
 
The committee shall hear the appeal. The hearing must be adhere to the Statutory Powers and Procedures Act.
 

Committee of Adjustment

The Committee of Adjustment is a Quasi-Judicial hearing board comprised of members of the public. Under the authority of the Planning Act, any municipal council that has passed a Zoning By-law, under Section 34 of the Act, may establish a Committee of Adjustment as the Town of Erin has done. The Town of Erin Committee of Adjustment consists of a chair and four other members. These are paid positions in which each Committee member is appointed by Town Council, running with the term of Council.

In accordance with the relevant provisions of the Planning Act, the Committee considers and rules on applications for minor variance.
In assessing the merits of a Minor Variance application, the Committee of Adjustment considers documentation provided in the application, recommendations provided in a report from Planning staff, comments received from other municipal departments and agencies through circulation, and comments received from members of the general public.  Section 45(1) of the Act provides that the Committee may grant a variance from the provisions of the Zoning By-law, in respect of the land, building or structure or the use thereof, where, in its opinion, the application passes the following tests:
  • The application is considered to be minor in nature.
  • The application meets the general intent and purpose of the Zoning By-law.
  • The application meets the general intent and purpose of the Official Plan.
  • The application is considered to be desirable for the appropriate development or use of the property.

Applying to the Committee of Adjustment
Applications are submitted to the Secretary-Treasurer of the Committee, who is responsible for circulation of the application and all other administrative duties in keeping with the requirements of the Ontario Planning Act.

Committee Meetings
The Committee holds regular meetings usually on the 3rd Wednesday of every month at 7:30 p.m. in the Council Chambers at the Municipal Office should an application be submitted.

Appeal a Decision
Appeals to a Committee of Adjustment decision must be filed within the appeal period to the Ontario Municipal Board

The Let’s Get Hillsburgh Growing (LGHG) Committee

 

Purpose: Formed in 2005, the committee is committed to the beautification and revitalization of Trafalgar Road in Hillsburgh.

 

Members:  The LGHG Committee members are interested citizens and representatives from businesses and community groups in the Hillsburgh area.

 

Activities:  Every year, the LGHG Committee is responsible for:

·        The hanging baskets and planters that adorn Trafalgar Road during the summer

·        Maintaining and replacing, as necessary, the brightly coloured banners that hang on the hydro poles

·        Replacing the hanging baskets in the winter with wreaths

·        The colourful laser-cut steel signs that hang on the hydro poles on Trafalgar Road. Eighteen signs were installed in October 2010 and the Committee is currently fundraising to purchase another thirty-four. This multi-year project will create a striking streetscape for Hillsburgh.

·        Spirit of the Hills Day, Hillsburgh’s Family Fun Day.  Since 2006, the LGHG Committee and the Hillsburgh Lions have joined forces to present this fun-filled event for the whole family.  Held on the third Saturday of August, Spirit of the Hills Day includes a classic car show, games for the children, musical entertainment, vendors and a BBQ. A silent auction is also held to raise funds for the Lions Club’s community projects.
